When the state declares war on the people

In 2009, the Indian Government launched a major anti-Maoist offensive in forest areas Operation Green Hunt. Fact-finding investigations have uncovered the atrocities security forces are committing in these areas, but now those very findings are being questioned.

13th November Public Meeting

A public meeting was organised by Campaign Against War on People in The Faculty of Arts, North Campus, DU on the 13th November. In spite of BJP’s Delhi Bandh call, and DUSU’s call for a University Bandh, slight rain, and posters for the event having been mysteriously torn up, over a hundred and fifty people attended the meeting. Representatives from many organisations including PUDR, AISA, Disha, DSU, Jan Hastakshep, Correspondence, JNU Forum Against War on People and NSI addressed the gathering. The group also launched its signature campaign against the state’s offensive addressed to the Prime Minister, which will be circulated in the university during the next few weeks. Campaign against War on People

The Indian government intends to deploy 100,000 troops – ostensibly against Maoist insurgents – in 7 states in central and eastern India, including Maharashtra, Chhattisgarh, Orissa, Jharkhand and Andhra Pradesh, a vast area inhabited by tribal groups. Forces withdrawn from Jammu and Kashmir (e.g. Rashtriya Rifles) and the Northeast are joining battalions of CRPF commandos, the ITBP, the CoBRA and the BSF, equipped with bomb trucks, bomb blankets, bomb baskets, and sophisticated new weaponry. Six IAF Mi-17 helicopters will provide air support to these ground forces, in which the IAF’s own special force, the Garuds, will participate. The actual strength of the intended targets of this massive action – the Maoist cadre – is believed to be no more than 20,000. Besides the dangers of any state offensive against any section of the people, the scale of the offensive suggests that the state is unable to distinguish the millions of tribals in this area from the Maoists, and has chosen the quick solution of war on the entire region. Several groups which are not Maoist – like the Vanvasi Chetna Ashram in Dantewada – have been clubbed with them and are being targeted. The basic question is, why is the state planning war against its most deprived, oppressed and impoverished populations?

Central India is rich in mineral wealth that is already being auctioned: Till September 2009, Rs 6,69,388 crore of investment had been pledged toward industry in the troubled areas—14 per cent of the total pledged investments in the country. All that stands between politicians/ big money bags and this wealth is the tribal people and their refusal to consent to their designs. Even constituent bodies of Indian state machinery acknowledge the gross failure of state in the tribal areas of the country in no uncertain terms. The Planning Commission Report on Social Discontent and Extremism, has clearly identified equity and justice issues relating to land, forced displacement and evictions, extreme poverty and social oppression, livelihood, malgovernance and police brutality as widespread in the region. The Approach Paper for the 11th Plan states:

Our practices regarding rehabilitation of those displaced from their land because of development projects are seriously deficient and are responsible for a growing perception of exclusion and marginalisation. The costs of displacement borne by our tribal population have been unduly high, and compensation has been tardy and inadequate, leading to serious unrest in many tribal regions. This discontent is likely to grow exponentially if the benefits from enforced land acquisition are seen accruing to private interests, or even to the state, at the cost of those displaced.

The Fifth Schedule of the Constitution grants tribals complete rights over their traditional land and forests and prohibits private companies from mining on their land. In spite of all this, in the name of fighting the Maoists the state – in blatant violation of Constitutional rights and against the recommendations of its own committees – is all set to evacuate the entire area of the tribals and ghettoise them by forcing them into ‘relief camps’, to allow free rein to big business. Instead of addressing the basic rights and needs of the tribals, the impatience of the state/big business in the face of the stiff resistance from them, is leading it to a full-scale war on people who are already fighting an everyday battle for livelihood and survival.

In the past as well the state has tried to crush all popular resistance, armed or not. It has repeatedly ignored and/or suppressed non-violent resistance, be it in Bhopal gas-victims or the ‘Narmada Bachao’ Andolan. Various human rights activists who have spoken out against its policies have also been targeted through draconian instruments like the Chhatisgarh Special Public Safety Act, 2005. It has also brutally assaulted protesters in Singur, Nandigram, Lalgarh and Khammam and conducted military offensives in Chhattisgarh, Jharkhand, Orissa, West Bengal and Andhra Pradesh that have been seriously questioned. Now, along with an increasingly uncritical, elitist and complicit media, it is set on drumming up war hysteria to legitimise its own extra-Constitutional programs. The fact that it has either rejected or dismissed offers of talks and mediations – while hypocritically calling for them – indicates the extent to which it is invested in this war. The Central Government’s military offensive further dilutes the federal character of Indian democracy as it covertly shifts the maintenance of law and order off the state onto the centre list.

This war on the people also entails a further shrinking of already limited spaces for democratic dissent and articulation of pro people development paradigms. It opens the way for the state to act with force against any form of dissent or struggle. Any individual or organization protesting against the policies of the state can be labelled as a threat to ‘internal security’. To understand the politics and economics of the current state offensive, we urge people to look beyond the current hype being built by the government and pliable sections of the media. This indicates the emergence of a dangerous consensus towards a police state that will render the people and resources pliable to the demands of global capitalism and authoritarianism.

We call upon all progressive forces – students, teachers and workers – to resist the latest plan of the Indian government. Stop state violence against people.

Raipur Rally against Displacement, Oct 6 2009

The rally was organised by “Chhattisgarh Visthapan Virodhi Manch” (Chhattisgarh Anti-Displacement Platform), which issued the following leaflet before the rally:

RALLY OF ANTI-DISPLACEMENT MOVEMENTS FROM ALL CHHATTISGARH IN RAIPUR ON 6TH OCTOBER.

The unrelenting loot of the abundant mineral resources of Chhattisgarh – iron ore, coal, limestone, bauxite, and even diamond and uranium has meant the total stranglehold of big corporates – foreign and Indian – over the State’s bureaucracy, polity, and even judiciary.

Multinationals Holcim and Lafarge have gobbled up the Indian cement companies and persist in earning super profits from the illegal exploitation of contract labour; Vedanta can get away with, and is in fact ably assisted by the State administration in, the criminal cover up of murder by negligence of nearly a hundred workers in a recent chimney collapse; Jindal and Monnet specialise in managing the pollution control department and so the Raigarh district, labouring under black clouds, drying water sources and disappearing forest cover, sees public hearing after public hearing where the public is never heard and clearances are granted, (Jairam Ramesh honestly called these environmental public hearings “match fixing” by the companies); a rash of sponge iron factories – mushroom in Raipur; Tata and Essar, with a little help from Collector Sahab, manipulate gram sabhas in the scheduled areas in gross violation of the PESA Act and employ every trick in the game to coerce people to accept compensations for land.

And in Bastar, where the huge ground clearing of 644 villages for “development by mining companies” is being resisted by lakhs of displaced adivasis, living in the jungles and therefore declared “outlawed”, who are struggling for their lands and livelihoods, the State is preparing to launch a full scale war ( now there is even talk of air strikes and American assistance) .

For the toiling people of Chhattisgarh, particularly the peasants and adivasis, this integration into the imperial loot machine that is called ‘development’, has meant displacement on an unimaginable scale. The whole of Raigarh district is dotted with heavily polluting sponge iron, steel and power plants, lorded over by Jindal. In at least half the cases the displaced have not even received the paltry compensations that have been declared their due. Many blocks of this district are notified scheduled areas and in the near vicinity of Reserve Forests, yet…

Not an inch of Jashpur district, from where human trafficking is reported on a large scale, will be left if the prospecting licenses applied by for by Jindal, MCP Kolkata and other companies are granted. Even though the law specifies that the consent of both owner and occupier are to be obtained and Jindal admits in writing that they have not obtained such consent, the entire machinery of the State Revenue department has been thrown into coercing people to grant such consent. Thousands and thousands of square kilometres have been applied for, covering 32 villages of Kunkuri block and 19 villages of Bagicha block, another 7 villages of Jashpur block and so on….

In Kawardha, Bilaspur and Dhamtari, the Reserve Forests to protect tigers, elephants and even snakes are going to be doing away with the poorest of poor of the tribal people including primitive tribes. Lofty promises of alternative land and compensation are meaningless when land rights are not ensured to the tribals before they are displaced as specifically laid down in the Forest Rights Act….

Not that the affluent peasantry are being excepted. 41 and subsequently more, leading to a total of 65 villages, of Raipur district are to be displaced for a glittering new capital region. Of course an international cricket stadium, convention centre, five star hotel complex, gems and jewelry and IT SEZ, and the bungalows of our Hon’ble MLAs (one fourth of whom are now “crorepatis”) are very much “public purpose” enough to justify this displacement. Touts of all colours are working overtime to persuade people to accept that monetary compensation, which may look attractive in a situation of failing agriculture but cannot last beyond a generation, as their fate.

The villages trapped within industrial areas are seeing their communal lands being illegally occupied by companies, and the bastis of the contract labourers who work in those factories are always under the shadow of the bulldozer, deprived of the basic amenities of water, sanitation and electricity. After long struggles these bastis have been included in the municipal bodies and the workers recognised as “citizens”. The villagers of village Chourenga which continuously resisted the setting up a sponge iron plant, are still rotting in jail on false murder charges.

In Rajnandgaon 7 villages are to be displaced for an airbase, presumably part of the State’s war preparations; and in the Raipur-Bilaspur belt, rich in limestone, a number of cement plants are to come up. The earlier bitter experiences of peasants of getting only temporary and contractual jobs during the construction period of plants and then in fact being pitted against outside workers has led to enormous tension with the unemployed rural youth. This is despite the State’s official rehabilitation policy which stipulates only permanent jobs as adequate compensation. Fertile and multi -cropped land is being acquired for the private profit of companies without even a thought of the social costs.

The Gandhian NGO Vanvasi Chetana Ashram which is trying to implement the recommendations of the NHRC to rehabilitate the villagers of 644 villages that have cleared out during the recent “salwa judum” campaign has faced demolition of their ashram, attacks and false cases on their karyakartas under the draconian Chhattisgarh Special Public Safety Act.

In every corner of the State, people are struggling against displacement.

Over the last four months about 20 grass roots peoples organisations from many districts all over Chhattisgarh – Raigarh, Jashpur, Bilaspur, Raipur, Rajnandgaon, Dhamtari, Dharamjaygarh, Dantewada and Korba have joined hands to form a loose front, cutting across traditional party lines, called the “Chhattisgarh Visthapan Virodhi Manch”, which is still growing.

This “Manch” is holding a rally in the capital city Raipur on 6th October, against all odds – despite its constituent organisations being poorly off, and having to brave the use of money power and muscle power against them by the companies.

We also know that the companies will be trying to “manage” the media.

Findings of fact-finding team into Sep 17-Oct 1 murders in Dantewada

Till now, no substantive information has been given in the media regarding the Gachanpalli killings of 17th September 2009 (during Operation Green Hunt) and 1st October killings at Gompad and Chintagufa villages by security forces. Nor have any reports appeared regarding detentions and arrests of several young men on 1st October. Information regarding looting, burning and torture which accompanied these operations have also remained unknown. Also, that people have fled their villages, are living in make shift sheds in the forest has gone unnoticed. The fact that on both these days, security forces (Cobra, local police and SPOs and Salwa Judum leaders such as Boddu Raja) went on a rampage stabbing and killing people, looting, burning houses and forcibly picking up young men is the other side of Operation Green Hunt which has been carefully kept away from public scrutiny. In order to ascertain these facts, a 15 member fact-finding team visited Dantewada area between 10th and 12th October 2009. The team comprised members from PUCL (Chhattisgarh), PUDR (Delhi) Vanvasi Chetna Ashram (Dantewada), Human Rights Law Network (Chhattisgarh), ActionAid (Orissa), Manna Adhikar (Malkangiri) and Zilla Adivasi Ekta Sangh (Malkangiri). The team was initially denied permission and was repeatedly questioned and interrogated at Dornapal and Errabore police camps on the way. The team spent a night in Nendra village (a rehabilitated village) and met witnesses and victims from several villages and gathered testimonies from them. Subsequently, the team spoke to District Collector and Superintendent of Police, Dantewada. While a detailed report is in the making, some of the important and significant issues are given below.

17th September 2009

1. Gachanpalli murders: In the early hours of 17th September, 6 villagers were murdered by security forces in this village. Dudhi Muye (70 yrs) who could hardly walk was murdered after her breasts were cut off. Family members who had fled the scene on seeing the security forces, found her lying dead in a pool of blood. Similarly, Kawasi Ganga (70 yrs) who could barely see was stabbed and murdered in his bed. He too was found by his family members who had fled from the house and had taken shelter in the forest. Madvi Deva (25 yrs) was tied to a tree and shot at three times and then beheaded. His grandfather who was accompanying him back to the village was a witness to this. The family hasn’t found his body. Three other villagers, Madvi Joga (60 yrs), Madvi Hadma (35 yrs) and Madkam Sulla were stabbed and murdered. The last two were killed in front of one witness, the wife of Madkam Sulla. Madvi Joga was killed after being stripped naked while ploughing his little plot of land. All the houses were ransacked, broken and burnt down. Family members are either living in sheds in the forests or have taken shelter with relatives. Many others have also taken similar shelter as their houses were burnt down by the security forces.
2. The case of Madvi Deva: This young man was a resident of Singanpalli village and had gone out in the morning of 17th for some family work. When he did not return his family searched for him. Two days later, a Patel from another village informed the family that he had been shot and killed by the security forces and his body was buried in the compound of Chintagufa PS. The Patel was asked to supervise the burial in the PS.
3. Burnt in hot oil: Muchaki Deva (60 yrs) of Onderpara was grazing cattle on the morning of 17th September. He was caught, beaten and dragged into the village by security forces. He was hanged upside down from a tree and a pot of hot oil was lit below and he was dropped into it. He was then pulled out and poured over with water. As a result, the upper part of his body is severely burnt and he has developed maggots in his wounds. He is still gravely ill and has no access to medical aid. Needless to say, he is afraid to leave his village.
4. Tied and paraded: 6 villagers, including 3 women were tied and paraded through Gachanpalli and other villages where the security forces went. Fortunately, they escaped as timely rains made it possible for them to flee.
5. Forced displacement and terror: families of those who were murdered by security forces and those whose houses have been burnt down vengefully, have fled the village and are living in make shift sheds in the forest. The condition of the others is no better as the entire village has been terrorized by security forces.

1st October 2009

1. Gompad ‘encounter’: SP Dantewada described the operations in Gompad village on 1st October as an ‘encounter’. An encounter with a difference: while 9 villagers were killed by security forces in the village and their bodies were left there, no casualties were inflicted on security forces. This too the SP confirmed. 4 members of one family, Madvi Bajar, his wife, Madvi Subbi, their married daughter, Kartam Kanni and their young daughter, Madvi Mutti were stabbed and killed inside house. So too were two other villagers from Bhandarpadar, Muchaki Handa and Madkam Deva, who were staying the night over at Madvi Bajar’s house on their way home from Andhra Pradesh where they had been working. Another couple, Soyam Subba and Soyam Jogi were stabbed and killed inside their house. Yet another villager, Madvi Enka was stabbed inside the house and then dragged all over the village. Before leaving the village, the security forces shot him and left his body. All 9 deaths, like the ones on 17th September, were preceded by stabbing and the bodies were left in the village. When the team asked the SP about recovery of bodies from the encounter site, the SP stated that Naxalites had ‘taken them away’.
2. More killings: In Chintagufa, a 45yr old man, Tomra Mutta was stabbed and shot inside his house. On seeing the sudden arrival of the security forces, Tomra Mutta ran to protect his family. He was shot in the process. The team confirmed 10 murders that had taken place that day but there is apprehension that the total number of killings may be much higher as many villages could not be contacted or accessed. The SP confirmed that two sets of raid parties set off that day comprising of Cobras and local police. Hence, the details with the team do not give the entire and exact picture of how many villages were attacked and targeted.
3. Travails of a 2yr old: Madvi Bajar’s grandson was not spared. He is all of two and yet the security forces beat him, cut four of his fingers, broke his teeth and cut off part of his tongue.
4. 8 arrested and 2 missing: Ten young men between 18-32 years were beaten and picked up by security forces from Mukudtong and Jinitong villages on 1st October. Eight have been shown as arrested in a case that was registered on 3/10 at Konta PS under various sections of IPC, Arms Act and Explosives Act. They are currently lodged in Dantewada jail. However, two still remain missing. Female relatives who went in search of those missing at the Konta PS were harassed, made to affix their thumb impression on blank documents and driven away. When they returned two days later, they were abused, told not to return and informed that the men had been taken to an unknown place.
5. Looting and Burning of property and houses: As many as 9 instances of looting and burning by security forces were reported to the team. Unlike the 17th September killings which were followed by arson and burning of the houses of those murdered, security forces on 1st October looted homes. They took away paddy, pusles, brass pots and poultry from many homes. Money, ranging from 300/- to 10,000/- was stolen from these houses. Destruction of property, particularly burning down of houses was carried out in as many as seven instances.
6. Harassment and torture: Witnesses reported several instances of harassment at the hands of the security forces. In Gompad, one villager was caught and interrogated and then shot at in his leg. He managed to run away but still has the bullet injury and has had no medical treatment. In Chintagufa, security forces tied another man and made him walk to Injaram PS. They severely beat him and also attacked him on his toe with a knife. He was finally let off in the evening.
7. Presence of SPOs and Salwa Judum leader with security forces: Residents of Mukudtong village confirmed that the ‘raid’ party was accompanied by known Salwa Judum leader, Boddu Raja of Injaram camp and they recognised SPOs Pande Soma of Phandeguda village and Ganga of Asarguda village. Residents of Gompad village were able to recognize SPO Madvi Buchcha who belongs to their own village.
8. Forced displacement and terror: Several families are living in makeshift sheds in the forest area as their houses have been burnt down. Those who are unable to run and flee are living in terror in the villages and residents and relatives have helped them to repair their houses and have given them other support.

Conclusion:

While the team could only meet residents of some of the villages, there is apprehension that a much larger number of people were killed on both days in other villages. The same is true for instances of torture, loot and detentions. The clamp down on information makes it impossible to know what exactly is happening in distant and far flung villages. However, what is clear is that the operations conducted by security forces have compelled villagers to leave their villages, flee into the forests and/or take shelter with relatives in other villages.

The condition of those who are residing in their villages is precarious and vulnerable. Given that the government has not complied with the Supreme Court order on rehabilitation of displaced families (families which were displaced in the earlier phase of Salwa Judum violence), the new and current phase of violence by security forces has added to the crisis in these remote and inaccessible villages. Instead of rehabilitating people, the government, in the name of combating Maoism, is bent upon unleashing its lethal paramilitary forces and evicting people from their villages. It is imperative to immediately end to this policy of eviction and terror and enable people to settle in their villages.

Demands

1. That the government must accept responsibility for murders committed on 17th September and 1st October by security forces and file FIRs against those responsible. Further, the government must acknowledge all instances of torture, illegal detention and destruction of property. FIRs must be lodged in each case and compensation given in each instance.
2. That an impartial inquiry (comprising civil society representatives and representatives of organizations working in the area) be conducted into the incidents of murder and acts of arson, loot and torture on 17th September and 1st October by security forces. The focus should be to bring out the truth behind these killings an also investigate the extent of the operations carried out on both days.
3. That the government must immediately take steps and show its conviction in the Supreme Court order on rehabilitation of villages and implement it immediately. The above described incidents of 17th September and 1st October have created fear and panic and compelled villagers to flee. Unless the government implements the SC order, villagers will not be able to live in their villages.
4. That along with the implementation of the above mentioned order, there be an immediate end to cordon and search operation carried out by security forces in these areas. Lack of rehabilitation coupled with an ever increasing size of the paramilitary forces in such backward areas with low population density raises fears of repeated incidents, such as the ones described above.

Statement on the NHRC report on Salwa Judum

Issued by Campaign for Peace and Justice in Chhattisgarh

Since 2005 the Chhattisgarh government has claimed that the Salwa Judum is a “peaceful people’s movement”, that “the villagers are never forced to join the camps”. They claimed that no minors were appointed as SPOs. It also resisted any independent enquiry, saying “There is no failure on part of state of Chhattisgarh and therefore independent investigation is uncalled for and unwarranted.” The NHRC investigation into Salwa Judum which was carried out on the orders of the Supreme Court found that this claim by the Chhattisgarh government regarding Salwa Judum was patently false. They found prima facie evidence of large scale burning of villages, large numbers of missing people, the fact that many people had been forced into camps against their will (though most they claim have subsequently returned), and the appointment of minors as SPOs in the initial stages at least. Some Nelasnar camp residents, they note, “left the village due to atrocities committed by the Naga police.” This one example is clearly the proverbial tip of the iceberg. The NHRC investigation revealed that SPOs have been involved in “certain incidents of atrocities against the tribals” and in some instances (e.g Matwada camp killings), the security forces and SPOs seemed to be prima-facie responsible for extra judicial killings. They have also not ruled out the possibility that, as in the Matwada case, other FIRs registered could be false.

However, given the powers and responsibility of the NHRC, it has manifestly failed to bring out the full truth of what is happening in Dantewada district, Chhattisgarh. The National Human Rights Commission is a statutory body, mandated to be an autonomous overseer of human rights across the country. The current report is unfortunately a negation of this responsibility.

There are inherent infirmities in the present report (i) the composition of the team which consisted solely of police, (ii) the process of public enquiry, which involved SPOs and Salwa Judum activists acting as translators, coupled with intimidation of witnesses (iii) the manner in which conclusions have been arrived at by the NHRC’s investigating team. It is these which has led the NHRC investigation team to downplay its own findings on the atrocities committed by the SPOs and Salwa Judum activists and concentrate on the violence of the Naxalites. Curiously despite being so focused on the Naxalites, the report nowhere mentions that the state is already seized of this problem, having sent more than ten battalions of paramilitaries to the district, and spent crores of rupees on battling Naxalism. It did not need an investigation by the NHRC to uncover the Naxalite ‘problem’.

1. Composition of the team and method of enquiry: The investigation team comprised solely of police officers. It did not have any representative of the local tribal communities or even any of the NGOs associated with the NHRC who had asked to be associated with it. The team went to various Salwa Judum camps and villages in an armed convoy which included Salwa Judum leaders and members, Special Police Officers (SPOs) and the Superintendent Police of Dantewada. Concerns that the arrival of a convoy of anti-mine tanks, preceded by road clearing exercises, would do little to instill confidence in villagers who were already terrified by the violence of the Salwa Judum and security forces, had earlier been raised with the NHRC and have been fully borne out by the findings of the investigating team itself. The NHRC report itself acknowledges at least two instances, in Pusbaka and Chikurubatti villages, where the villagers ran away seeing the police/CRPF accompanying the team.

2. Flawed Investigation – insufficient and biased acceptance of evidence:
It is not just the petitioners who have been raising the issue of human rights violations by Salwa Judum and security forced in Dantewada and Bijapur. Several independent civil and democratic rights groups have been consistently raising questions about the manner in which the government has armed civilians and the impunity with which the militarized nexus of Salwa Judum, Police, SPOs and the CRPF has unleashed violence on the local population. This is also probably the only instance where several government agencies, including the Planning Commission, the Administrative Reforms Commission, National Commission for Women and the National Commission for Protection of Child Rights, have also condemned the counter-insurgency strategy employed by the government. The NCPCR report based on a fact-finding by Prof. Shanta Sinha, Mr. JM Lyngdoh (former CEC) and Mr Venkat Reddy, based on testimonies of at least 35 victims in Cherla, noted that “many people shared accounts of family members being killed and women raped by the Salwa Judum” and again, based on a public hearing in Kirandul, “There were numerous accounts of family members being killed for resisting the Salwa Judum”. The NHRC has unfortunately chosen to ignore all such reports.

Though NHRC report claims to reach several conclusions, it summarily rejects several of the complaints in the petition by saying that they have “not been substantiated”, based either on insufficient evidence or a specious acceptance of the police version. Some instances are:

i) The NHRC has made registration of FIRs as the bench mark of ascertaining whether an incident of violence took place or not. The NHRC seems to have charily ignored the fact that in cases where state agencies are responsible for human rights violations people would be unable to lodge FIRs for fear of their life or that false FIRs may have been lodged by the police themselves falsely implicating others. This even though the report itself admits at least one instance where a villager was killed by Salwa Judum activists no FIR has been registered.

ii) The report uncritically accepts the police version of the cases and makes that the basis for “substantiation” or otherwise. This even as the report itself has had to admit at least one instance- in the Matwada case which was highlighted due to the efforts of local groups, that false FIR has been filed by the police blaming Naxals for an incident which was prima facie committed by Salwa Judum and security.

iii) In at least two cases, the NHRC visited the wrong village – of the same name but in a different thana. In the case of Polampalli in Usur thana, which was used as a test case to say that rape was not substantiated, despite the correct details being mentioned in the petition, the NHRC team visited Polampalli in Dornapal thana.

iv) The NHRC team has ignored the evidence provided by independent journalists and others which contradicted the police version and accepted the police version at face value. In the Santoshpur case for instance, at least 4 independent journalists have separately and one after another confirmed to the killing of Kodiya Bojja by SPOs, based on interviews with next of kin soon after incident. NHRC however uncritically accepts police version that he was killed by Naxalites.

v) Most strikingly, all testimonies given by IDPs in Andhra Pradesh regarding killings of their relatives by Salwa Judum and SPOs have been discarded, while all testimonies given by camp residents and villagers regarding killing by Naxalites has been accepted at face value. The AP testimonies have been ignored even when they are corroborated by the evidence of burnt and abandoned villages (e.g. Kottacheru, Lingagiri etc.)

3. Several misleading conclusions: It is not clear how NHRC came to its conclusion that no village was being discriminated against for not joining Salwa Judum camps when it notes that rations are available only in camp and that Salwa Judum is identified with the camps, and that “the only government agency active in the area is the police”. The National Commission for the Protection of Child Rights had noted in its fact-finding report, that ‘A big problem is that schools and Anganwadi teachers have been shifted from the villages to the camps leading to a concentration of service-providers in camps and no services available to those who are still living in villages.’

4. The NHRC avers to some instances where security forces and SPOs seem to be prima facie responsible for extra judicial killings. It states that it came across certain cases in which the “excesses” have been committed by ‘public servants’ and where the State has proceeded against those “who failed to operate within the four corners of the law”.

However it does not give details of any such instances. Till date, the Dantewada and Bijapur district administrations, the Chhattisgarh Police and the Chhattisgarh Government have not accepted or made public the cases where Police Officers, Special Police Officers or CRPF personnel in Dantewada and Bijapur have been proceeded against for violation of law.

5. Justifies Vigilantism: Most worrying however is the manner in which the NHRC report openly justifies Salwa Judum on the grounds that people cannot be denied the right to defend themselves against the atrocities perpetrated by Naxalites thus condoning civil vigilantism and arming one section of the society against the other, which in fact represents abdication of the State itself. Justice Rajendra Babu, Chairperson, NHRC had said in one interview, “The NHRC has not given a clean chit to Salwa Judum. What we said in our report to the Supreme Court was that the problems afflicting Chhattisgarh are not law and order problems but socio-economic ones.” Burning villages, and extra-judicial killings are surely law and order problems. Meanwhile the Raman Singh government which has come under a lot of criticism for its support to Salwa Judum is going all out to publicise this biased report as a vindication of its disastrous strategy.

We hope that the Supreme Court and the wider public sees the biases the report evidently demonstrates. At the same time, even the limited findings by the NHRC are sufficient to indict Salwa Judum and SPOs as an extra-constitutional, vigilante force which must be disbanded forthwith. Those who wish to must be allowed to return home, and all victims, whether of Salwa Judum or Naxalites must be given compensation on an equal footing. A judicial enquiry is essential to establish the scale of victimization and prosecute those who are guilty.

Anti-Maoism, McCarthyism and the Indian State

Being the only “policeman” who “has ever risen to so much influence in India”, Indian National Security Adviser MK Narayanan seldom minces words in revealing the designs of the Indian State for “national security”. He recently pronounced the focus of the state’s strategy against leftist militancy in the country. In an interview to The Straits Times (1), he clearly emphasised that it is the intellectual appeal of the Maoists that is letting down the Indian state in its fight against the Maoists. “…[W]e haven’t been able to break their intellectual appeal that they seem to still have”.

Narayanan further adds that “large numbers of the intellectual elite and civil liberties bodies provide a backup to the movement in terms of agitprop and other activities”. The fact that the Maoists “are still able to get support of intellectual classes is disturbing. Unless we can divorce the two … [defeating the Maoists] is not that easy”.

When asked if the Maoists are getting outside support, he said, “we have not seen any kind of infusion of arms or ammunition”. However it is the “educated elite…that gives them a connection to the outside world”. Evidently, it is that “connection” which needs to be broken.

In order to sever this “connection”, the Indian state must find intellectual scapegoats (like the McCarthyite era in the US had the Rosenbergs and others) to terrorise the “educated elite”. Hence, we have Binayak Sen, Ajay TG… And the list is daily growing.

What is anyway McCarthyism? Truman, not a leftist by any means, defined it as “the corruption of truth, the abandonment of the due process of law. It is the use of the big lie and the unfounded accusation against any citizen in the name of Americanism or security. It is the rise to power of the demagogue who lives on untruth; it is the spreading of fear and the destruction of faith in every level of society.”

So with the ideologies of Indianism/Hinduism and security defining every move of the Indian state, aren’t we in the same situation?

Should we be surprised by the National Human Rights Commission’s submission to the Supreme Court regarding Salwa Judum’s atrocities leaked to the Economic Times? The official human rights body “found that many of the allegations [against Salwa Judum] were based on rumours and hearsay, and devoid of facts. Again, many of the villagers whose names figured in the column comprising victims of Salwa Judum or the security forces were actually found to have been killed by Naxalites. FIRs had been registered in most of these cases and the state government had also doled out compensation to relatives of those killed. NHRC teams also discovered many of the villagers whose names figured in the list were actually Naxalites who had been killed in encounters with the security forces. A few other villagers were found to have died of natural causes, while yet another group of villagers whose names figured in the list of dead were actually found to be alive” (2). NHRC’s arguments here are quite clear and very logical –

if Salwa Judum or the security forces killed somebody, (s)he must be a naxalite; if (s)he was not a naxalite, then it’s obvious that (s)he was killed by the naxalites.

Isn’t this their “truth”, or Truman’s “corruption of truth”?

Chhattisgarh and the danger of dissent

If Ajay TG had been smart enough to know where to point his camera, his films might have been showing in Osian today. As it stands, he is in Durg jail, 40 km from Bhilai, where his uncle would sell tea and his father would sell chickens near the steel plant. He started making films 7-8 years ago, photographing, as he says, in a statement, “daily life, festivals and rituals of Durg and particularly my own neighborhood, an old village now surrounded by urban growth.” He would also make posters of poems and put them up in banks and other public places “to reach a wider public than that reached by poetry books.”

In Chhattisgarh, these are acts of terrorism.

This week, www.releaseajaytg.in, a website, was set up by a committee for his release. Playwright Habib Tanvir, activist Aruna Roy, professor Dr Kamal Chenoy, director ActionAid India, Harsh Mander, law expert Usha Ramanathan, journalist Siddharth Vardharajan, among others, are its members. Renowned film-maker Mrinal Sen who signed the petition condemning Ajay’s arrest, says: “I wish I was 30 years younger, so that I could have physically joined you all in this campaign.” “Chhattisgarh was always a peaceful place and it is a great shame that artists, film makers and journalists are being targeted in this state,” said Tanvir. “The voice of a creative person is being silenced again.”

There is a reason why Ajay TG’s story started moving in this direction.

His camera angles, to start with, were wrong. British photographer Margeret Dickinson who taught him the use of the camera, notes that, “even as a student, Ajay instinctively tended to opt for a non-authoritarian point of view when developing a film”. For example, when he made a short on malaria prevention, the story Ajay told was not from the point of view of a health campaigner but from that of village children confronted with a friend’s illness. This is a man who joins campaigns against child labour and has strong views on violence.

Ajay joined the Peoples Union for Civil Liberties (PUCL) in Bhilai, a leading civil rights organisation, as a voluntary member. Dr Binayak Sen, is its general secretary. Ajay starts making films on human-interest stories: on old-age homes, health, the politics of power in two adivasi melas. He also makes a film on Binayak Sen.

Are these crimes?

National Award winning cinematographer Rajan Palit asks whether the decision to investigate state terrorism creatively is enough to be branded a Maoist. “For the last 20 years, even civil society efforts in Chhattisgarh to protect land, water, culture and livelihood have been attacked,” agrees film-maker maker Amar Kanwar, who put together the committee for the film-maker’s release. “The message the police is sending out is — if you see something wrong with the system, do not make films about it. They are making sure, what people see, are not told.”

The objective of Ajay TG’s arrest is not Ajay TG. It is to tell everybody else that if you film and if you write, this is what will happen to you. It is to tell the local journalist, the local film-maker and the local poet to look elsewhere and clear out of the way.
